Abstract
One of the stages in postponing payment of receivable obligations (PKPU) is verification of receivables. The possibility of rejection of receivables claims at the verification stage may occur, but there are no legal remedies that can be taken by creditors, either ordinary legal remedies or extraordinary legal remedies, as well as the authority of the supervisory judge to reject creditors' claims at the verification stage. This problem formulation analyzes the legal protection for creditors' claims which are rejected at the receivables verification stage by the management in the PKPU process as well as the authority of the supervisory judge in the event that creditors' claims are rejected at the receivables verification stage. This type of research is normative legal research and uses a statutory approach, conceptual approach and case approach. Law Number 37 of 2004 concerning Postponement of Debt Payment Obligations and Bankruptcy does not regulate legal remedies if receivables are rejected during receivables verification. Efforts are made when this happens, the supervisory judge has the authority to reconcile creditors and debtors in the determination. The debtor does not need to wait for the peace homologation to appear first in the event that his claim is rejected in the receivables verification to file an appeal to the Supreme Court. The results of this research. With the Constitutional Court decision no. 23/PUU-XIX/2021 as a form of debt settlement and open cassation legal action is the right effort to pay attention to the rights of creditors and debtors.
