Abstract

The purpose of this research is to analyze and find out the procedure for transferring Copyright as inheritance based on Law Number 28 of 2014 concerning Copyright. The research method used is a type of normative legal research, namely legal research using legal rules, legal principles and legal doctrines to answer the issues at hand, in this study also uses 2 methods of approach, namely the statutory approach and conceptual approach. The results of this research indicate that although the procedure regarding the transfer of Copyright as wairsan is not regulated in detail in Law Number 28 of 2014 concerning Copyright, it does not mean that it negates the stages that can be taken, the stages or procedures that can be taken if Copyright is transferred by inheritance are: 1) The heirs make a deed of inheritance as authentic evidence of ownership of rights accompanied by a death certificate and certificate of inheritance, documents on the transfer of rights by way of inheritance made by a notary or official / agency authorized in the making of deeds of inheritance; and 2) The heirs as the owner of Copyright shall register with the Directorate General of Intellectual Property and must be accompanied by documents of transfer of rights and announced in the official news on each type of Intellectual Property.
