Abstract
Undang-Undang Nomor 17 Tahun 2016 tentang Perlindungan Anak memberikan perlindungan khusus kepada anak-anak. Undang-undang ini mengatur hak-hak anak, tanggung jawab orang tua, pengasuhan anak, serta penanganan kasus kekerasan dan pelecehan terhadap anak. Penelitian ini bertujuan untuk mengetahui dan menjelaskan terkait pertimbangan hukum yang diambil oleh hakim dalam menjatuhkan keputusan dalam kasus tindak pidana pemerkosaan terhadap anak pada perkara No. 1/Pid.Sus-Anak/2023/PN Bbs dan untuk mengetahui dan menjelaskan mekanisme perlindungan hukum yang diberikan kepada anak-anak yang menjadi korban pemerkosaan. Jenis penelitian ini adalah Normatif. Dalam penelitian ini, terdapat tiga pendekatan yang diterapkan, yaitu pendekatan melalui analisis peraturan hukum (statute approach), studi kasus (case study), dan pendekatan konseptual (conceptual approach). Pertanggungjawaban Sistematika pada penelitian ini berfokus mengkaji Putusan Hakim pada kasus Pemerkosaan Anak dengan nomor perkara No. 1/Pid.Sus-Anak/2023/PN Bbs secara detail dari setiap bagian bab beserta sub bab yang dibahas, dan memberikan uraian-uraian yang mendukung dalam proses mengkaji Putusan Hakim Tersebut. Pertimbangan hukum (Ratio Decidendi) Putusan No.1/Pid.Sus/Anak/ 2023/PNBBS terdiri dari 4 unsur yaitu : Unsur Orang atau Manusia, Unsur Kesengajaan Melakukan Tipu Muslihat, Unsur Persetubuhan atau Hubungan badan, Unsur yang melakukan, yang menyuruh melakukan dan turut serta melakukan. Mekanisme perlindungan hukum yang diberikan bagi anak korban pemerkosaan yaitu Dengan cara preventif : dapat dilakukan dengan memberikan informasi, pendidikan, dan pemahaman kepada masyarakat tentang hukum dan aturan yang berlaku. Upaya Perlindungan Hukum Preventif dengan memberikan penyuluhan hukum, pemberian sanksi administratif, serta tindakan pencegahan kejahatan seperti patroli keamanan dan pengawasan keamanan. Dengan cara represif ; dapat dilakukan restitusi dan pemberian bantuan medis/bantuan rehabilitasi psiko-sosial dalam rangka restorasi kondisi korban dari segala aspek, untuk mekanisme restitusi diatur di dalam Pasal 5 PERMA Nomor 1 Tahun 2022 tentang Tata Cara Penyelesaian Permohonan dan Pemberian Restitusi dan Kompensasi Kepada Korban Tindak Pidana.
