Abstract

At the beginning of 2018, an extraordinary incident struck Asmat Regency, as many as 72 children died in this tragedy, namely 66 children due to measles and six children due to malnutrition. With this article, the aim is to find out whether neglecting malnutrition is a state violation, if it is a violation, what types of violations have been committed by the Indonesian state regarding the case of malnutrition in Asmat Regency and to find out what the state's responsibility is. The type of research used is normative legal research using a statutory regulation approach and conceptually by analyzing all laws and regulations relating to human rights and food and nutrition rights. Based on the conclusions from the discussion in this research, the author found that this incident was a violation of the Right to Food and Nutrition which occurred through acts of neglect by the State including failure to take appropriate steps (such as in the covenant), failure to reform, revoke and eliminate regulations, legislation and obstacles that are not in accordance with the covenant immediately and without delay, failure to monitor HAPG and at the same time constitute a violation of human rights because it is unable to protect and fulfill basic human rights. The rights that are violated by the state are the right to health, the right to children's growth, the right to protection, the right to children's welfare, the right to education, the right to a decent standard of living and also the right to life which is a gift from God. Meanwhile, due to a violation, the State is obliged to take responsibility, namely the Ministry of Agriculture together with the Logistics Agency (Bulog), the Food Security Agency which is responsible for meeting food availability, food affordability and food accessibility; The Ministry of Health is responsible for conducting reviews, treatment and monitoring related to nutrition and health so as to achieve a decent life with good nutrition and health and free from malnutrition; The Central and Regional Government together with the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency through the land reform program remember that one of the obstacles is inaccessibility to food due to the geographical location of Asmat Regency.
