Abstract

Peninjauan Kembali (PK) adalah hak terpidana atau ahli warisnya untuk mengajukan permohonan peninjauan kembali kepada Mahkamah Agung setelah putusan pengadilan memperoleh kekuatan hukum tetap merupakan upaya hukum luar biasa yang diatur dalam Pasal 263 hingga Pasal 269 KUHAP di Indonesia. Permohonan peninjauan kembali hanya dapat diajukan satu kali, dan tidak ada peninjauan kembali di atas peninjauan kembali, kecuali dengan alasan terdapat berbagai putusan dalam satu obyek perkara. Proses peninjauan kembali ini memerlukan bukti baru (novum) yang tidak pernah dikemukakan sebelumnya atau bukti bahwa hakim telah salah dalam menerapkan hukum atau kekhilafan hakim, dalam memutuskan putusan hakim menggunakan ratio decidendi yang berisi alasan-alasan hukum, pengambilan putusan terkadang diwarnai oleh perbedaan pendapat oleh majelis hakim atau disebut dissenting opinion guna mencapai Asas keadilan maupun kemanfaatan, kepastian hukum, Setelah terbitnya SEMA No. 7 Tahun 2014 tentang permohonan PK, menyatakan pada Pasal 24 ayat 2 UU No. 48 Tahun 2009 tentang Kekuasaan kehakiman dan Pasal 66 ayat 1 atas perubahan UU No. 3 Tahun 2009 tentang Mahkamah Agung menegaskan PK hanya dapat dilakukan satu kali. Apabila timbulnya PK pada tahap kedua mengakibatkan ketidakpastiaan hukum dan tidak sesuai dengan asas peradilan cepat, sederhana dan biaya ringan. Rumusan masalah, Bagaimana ratio decidendi Peninjauan Kembali sebagai Upaya hukum luar biasa dan Bagaimana akibat hukum PK yang diajukan lebih dari satu kali. Penelitian secara yuridis normatif atau penelitian hukum doktrinal. Pembahasan mencakup ratio decidendi pendekatan kasus tindak pidana korupsi yang telah mengajukan PK dua kali. Dan setelah lahirnya SEMA No. 7 Tahun 2014 tentang Permohonan PK menyebabkan penumpukan perkara di Mahkamah Agung dan bertentangan dengan asas kepastian hukum apabila diajukan lebih dari satu kali menyebabkan masyarakat pencari keadilan tersandera dalam ketidakpastian karena selalu diliputi ketidak-tenangan atas upaya hukum PK kembali di kemudian hari.
