Abstract

Pregnancy is a very personal matter, and every individual has the right to privacy. A woman's right to decide when and if she wants to become a mother is important to self-control and a better future for women. An unwanted pregnancy can jeopardize a woman's physical and mental health, in which case a woman can decide to have an abortion based on her right to self-determination. Forcing women to undergo unwanted pregnancies is an act that violates their right to bodily autonomy. The purpose of this research is to find out the position of abortion based on self�determination in women and abortion arrangements in Indonesia and review the right to choose in women (Pro-Choice) and Feminist Legal Theory (FLT). The views of Pro-Choice and FLT provide strong arguments for protecting women's rights to abortion. Understanding and respecting women's bodily autonomy, health, and safety, and applying FLT principles such as the right to privacy and anti-discrimination, can help society view the issue of abortion from a more inclusive and respectful perspective. This research uses a normative juridical method that utilizes a statutory and conceptual approach. The result of this research is to ensure that women can have abortions based on their right to choose that access to safe abortion services is not hindered by practical and social barriers, and that the law on the ground is in line with the provisions of the two laws. However, certain restrictions must be followed, such as certain gestational age limits, counseling, and consent required.
