Abstract

Every Indonesian has the right to get the job they want. The term Indonesian society means that it includes all levels of society without any gender discrimination. Every human being is at the same level in terms of the equal rights that each individual has. During the 2019 Ministry of Defense CPNS selection, female applicants were not allowed to take part in the CPNS selection while pregnant. The statement in the CPNS selection technique shows ideas that are contrary to the 1945 Constitution Article 28D paragraph (2). The Ministry of Defense, as the implementer of the CPNS selection, responded that the prohibition was made for the selection series which required psychological tests to physical fitness. Whatever the reasons underlying this regulation, it still needs to be studied so that there is no discriminatory treatment of women from a human rights perspective. Various forms of legal protection for the rights of pregnant and postnatal women workers need to continue to be developed so that there is no discrimination in women's rights to get work. Apart from legal protection regarding the right to work, women's right to receive appropriate wages must also be fought for for the development of a democratic country that is fair and always upholds human rights as a basis for developing laws and regulations and reducing discrimination against women in Indonesia. The aim of this research is to find out whether the prohibition on pregnancy for prospective State Civil Servants is a violation of Human Rights or not and to find out and analyze whether the legal protection rules for female Civil Servant Candidates who are pregnant have been implemented. This research uses normative legal research, normative legal research is legal research to find legal rules, legal principles, and legal doctrines in order to answer issues in the research and find solutions to existing problems.
