Abstract
The aim of this legal research is to determine the legality of members of the National Police who carry out the function of advocate from a criminal law perspective. This research was conducted using a juridical-normative method and supported by a statutory approach, which will later discuss law number 18 of 2003 concerning advocates which confirms the procedures for appointment, oath, status, action and dismissal of advocates until on the code of ethics for advocates which must be implemented based on principles. However, unfortunately, the use of the advocate function is used by dual profession civil servants or state officials (polri) without paying attention to the provisions referred to in Law Number 18 of 2003, this causes a conflict with the National Police Chief's Regulation Number 2 of 2017 concerning procedures for providing assistance. law by the National Police of the Republic of Indonesia, which means that the National Police provides legal assistance to fellow members of the National Police inside and outside the court, and there is evidence of a warrant (sprin) signed by the head of the National Police, which can proceed in the same way as an advocate's KTPA. If we trace the Regulations on the Chief of Police who carries out the function of an advocate for his fellow members, the absence of confirmation as intended in Law No. 18 of 2003 injures advocates and ignores the requirements to become an advocate, so that the legality of police members who carry out the function of an advocate can be confirmed.
