Abstract

The purpose of this research is to understand the procedures that must be fulfilled by Indonesian citizens if they wish to have a marriage abroad and to understand how the legalization of interfaith marriages of Indonesian citizens is related to those carried out abroad. The type of research used in writing this thesis is a type of legal research using a statutory approach method (Statue Approach) and a conceptual approach method (Conceptual Approach). This research focuses on discussing interfaith marriages according to the Marriage Law, the legal status of interfaith marriages, the problems of interfaith marriages abroad, as well as the legal consequences arising from interfaith marriages. Based on the research methods and legal materials used in writing this thesis, it can be concluded that the phenomenon of interfaith marriages often occurs and cannot be avoided in social life so that it can cause problems in administrative matters because there are no clear regulations and say that interfaith marriages are forbidden. Even though interfaith marriages in Indonesia cannot be justified, in this case the Population Administration Law seems to provide a great opportunity for the continuation of interfaith marriages, so clarity is needed regarding the regulations governing them so that the Indonesian people continue to have legal certainty regarding the phenomenon of interfaith marriages.
