Abstract

Legal protection for consumers of concocted jamu containing BKO is the focus of this research. The legal problem arising from the case in this study is that there is no law that specifically regulates the legal protection of consumers of concocted herbs in Indonesia if the consumer suffers a loss. In this research, two problem formulations are produced as the basis for discussion, namely how the legal protection of consumers of concocted herbs and how the form of responsibility for losses suffered by consumers due to concocted herbs containing medicinal chemicals. This research uses normative research methods with a statutory approach and conceptual approach. The jamu racik business is a business that stands without a production permit and distribution permit, because the products circulated by the jamu racik business actors are herbal products from producers in the traditional medicine industry that already have a production permit and distribution permit. With the results of the research, if there is an error made by the business actor of jamu racik containing dangerous medicinal chemicals (BKO) which then causes harm to consumers, of course this has violated consumer rights as regulated in Article 4 of the Consumer Protection Law and violated Article 8 paragraph (1) of the Consumer Protection Law. The responsibility that can be carried out by business actors is compensation as the legal basis is regulated in Article 7 letter f of the Consumer Protection Law and Article 1365 of the Civil Code.
