Abstract

Human trafficking is a violation of human dignity and is contrary to human rights and legislation. The slavery that plagues society is under the guise of directing labor by promising high wages, a decent life, and so on. The triggering factors are the lack of employment opportunities in the country, lack of education, and lack of awareness by society. One example is the case of human trafficking among Indonesian Migrant Workers (PMI). The crime of human trafficking cannot be underestimated because it has claimed many victims. For this reason, legislation is very necessary in providing sanctions and protection to victims of human trafficking, especially groups who are considered vulnerable. The aim of this research is to find out how criminal sanctions are applied for perpetrators of human trafficking against Indonesian Migrant Workers, the right to restitution for PMI victims of human trafficking, as well as the government's efforts to eradicate human trafficking against PMI. This research uses a type of normative legal research which looks at problems from the study of legal materials such as books or articles about human trafficking as references for basic materials and secondary legal materials. This research uses a statutory and conceptual approach in order to obtain the results you want to research. Based on this research, it was found that the form of legal protection carried out by the government for PMI victims of human trafficking is in the form of preventive legal protection, namely to prevent violations before they occur, and repressive legal protection, namely final protection in the form of sanctions for perpetrators, and restitution for victims, and the government's efforts to eradicate human trafficking, such as improving education, economic empowerment, seeking guarantees, making multilateral agreements, collaborating with various government agencies, as well as social control measures such as tightening laws.
