Abstract

Decision of the Constitutional Court of the Republic of Indonesia No. 46/PUU-VIII/2010 has created a new dynamic in the legal context of the marriage of illegitimate children. Marriage is an agreement between a man and a woman to carry out the life of husband and wife, married life, continuing offspring in accordance with religious provisions. This research examines the guardianship rights of illegitimate children. According to Islamic law as contained in the KHI, in principle it has the same perspective as the Marriage Law. Article 100 KHI contains a formulation that is not much different from Article 43 paragraph (1) of the Marriage Law, where illegitimate children only have a lineage relationship with their mother and their mother's family. Even though according to Islamic civil law, illegitimate children do not have a ancestral relationship with their biological father, this does not mean that the biological father in human terms has no responsibility to the child born from his seed. Therefore, Islam provides a solution and makes it easier to grieve in the absence of a marriage guardian for children born outside of a legal marriage, namely by having a guardian judge (sulthan) who can replace the position of the guardian of the lineage (father and other male relatives).
