Abstract

This thesis research aims to determine the characteristics of the right to freedom of expression and to determine the suitability of the regulation of the offense of insulting the President and/or Vice President from the perspective of freedom of opinion in Indonesia. This research is normative legal research using a statutory approach and a conceptual approach. Meanwhile, the legal materials used are primary, secondary and tertiary legal materials. The results of this research show that the characteristics of freedom of expression are: (i) one of the human rights regulated in international and national human rights instruments; (ii) fundamental and original rights; (iii) derivative rights; (iv) part of political rights; and (v) rights that are derogable rights. So it can be said that the regulation of the offense of insulting the President and/or Vice President in Article 218 and Article 219 of Law no. 1 of 2023 is not in accordance with the right to freedom of expression, this is because: (i) it is not in accordance with the characteristics of freedom of opinion; (ii) contrary to the principles of democratic rule of law, one of the core of which is freedom of opinion; (iii) threatens freedom of expression in expressing opinions against the President and/or Vice President; (iv) position is not an object of insult in contrast to personal insult; and (v) contrary to the Constitutional Court Decision.
