Abstract

A notary is a public official who has the authority to make authentic deeds and has other authorities as intended in this law. This authority will always give rise to a burden of responsibility on someone who is given that authority so that the person who is given the authority has an obligation to do what they do. A deed is a document as evidence that is signed which contains events that form the basis of a right or obligation, which was made from the start intentionally for proof. The authority of a Notary in making authentic deeds has the consequence of giving birth to a very big responsibility in providing legal certainty to the public so that the Notary remains responsible for the deeds that have been made while he is still in office or when he has retired. Automatically, the Werda Notary is no longer permitted to carry out his duties and authority in making authentic deeds. This research examines the accountability of a Werda notary for the deeds he or she has made and how the legal protection is for parties who use notarial deeds made by a Werda notary. The research method used is a normative research method with a statutory approach and a conceptual approach to analyze legal rules, legal principles and relevant legal doctrines in order to provide answers to legal issues. This research aims to find out, understand and describe the responsibility of the Werda Notary for the deeds he or she has made and the legal protection for parties who use notarial deeds made by the Werda notary. The results of this research conclude that a Notary is still responsible for deeds that have been made while he is still in office or when he has retired. The form of responsibility of a notary whose term of office has ended for violations of the notary position law, can be held accountable both administratively, civilly and criminally for various sanctions and a regional notary does not have the authority to carry out his activities as a notary, including making authentic deeds. The legal consequence of a deed made by a Notary Public is that the deed does not have the power of proof as an authentic deed but only has the power of a private deed.
