Abstract

This thesis aims to determine the consideration of the judge in deciding the case against drug addicts and abusers.This topic is interesting to study because of the differences in court decision number 154 / Pid.Sus/2019/Pn Mam and decision number 389/Pid.Sus / 2021 / Pn Sgt and legal protection for drug abusers.In both cases, the perpetrators were drug abusers. In the law on narcotics, there are also provisions regarding the legal protection of individuals related to the abuse of narcotics. This includes the right of access to medical and social rehabilitation. Unfortunately, the implementation of this legal protection is not optimal.The research method used in this study is normative juridical Law Research (legal research).While the approach used in this study is the approach of legislation(statue approach),conceptual approach(case approach) and the legal materials used are primary legal materials and secondary legal materials.Based.The result of this study is the verdict of the judge in the case of narcotics abuse is often inconsistent, because it is influenced by several factors such as economic, social conditions, and legal facts that arise during the trial. The judge's basic consideration in determining whether the offender will be rehabilitated or convicted is based on evidence that the person is actually a victim, and this is supported by the results of an assessment from the hospital or rehabilitation site, as well as testimony from a doctor who explains the extent of his dependence. In addition, the application for rehabilitation from the defendant is also a consideration factor. It should be noted that the implementation of legal protection regulated by the Narcotics Law has not been fully achieved properly and has not been in accordance with the objectives mandated by the law itself and the government's efforts in combating narcotics abusers have been quite effective.
