Abstract

Adopted children are taken from other people to be cared for, educated and cared for, supported by their lives with full attention and affection, and treated by their adoptive parents as if they were their own children without giving them the status of a biological child. Regarding the issue of inheritance, Islamic inheritance law which refers to article 209 of the KHI does not turn a blind eye to the fact that adopted children receive inheritance assets from their adoptive parents amounting to 1/3 of the inheritance of their adoptive parents and vice versa, the gift of inheritance can be done by means of a will, and if the adopted child does not receive a will then Article 209 KHI paragraph 2 provides a rule that an adopted child who does not receive a will will receive a mandatory will. The adoption of the child is made in accordance with applicable provisions, based on problems that give rise to inheritance disputes. Because the position of the adopted child's inheritance is clear, the adopted child remains an adopted child, and cannot become the heir of his or her adoptive parents. The Prophet's hadith explains clearly that a will is not permitted to exceed 1/3 of the inheritance, so in the case of inheritance, an adopted child is clearly not permitted to receive a share that exceeds that of a biological child or exceeds 1/3 of the inheritance of his adoptive parents. However, there are also certain schools of thought that prohibit the distribution of wills to adopted children because they are not their own flesh and blood descendants. In addition, to implement a mandatory will of more than one third, there must be approval from the heirs concerned. If the adoptive parents do not have any other heirs, it is true that there are no biological children or siblings, then the inheritance left behind can be given entirely to the adopted child through a mandatory Will.
