Abstract

Narcotics crimes are very disturbing for all countries in the world, as well as in Indonesia itself. Due to the uncontrolled distribution of narcotics, it is an extraordinary crime. The police are one of the institutions that have the right to arrest narcotics crimes. Several stages have been carried out starting from arrest, detention, confiscation, inspection. Regulations regarding criminal sanctions against police who are late in destroying narcotics still contain vague norms. In Law Number 35 of 2009 concerning Narcotics it is stated that the handover of confiscated goods as referred to in paragraph (1) can be carried out within a maximum period of 14 (fourteen) days if it relates to an area that is difficult to reach due to geographical or transportation factors. However, if the specified limit has been exceeded, the sanctions received are unknown and there is no legal certainty that regulates them. The aim of this research is to find out what punishment should be given to the police if they are late in destroying narcotics evidence. The research method used is normative. This type of research focuses on collecting legal materials and searching for the truth to get solutions to problems. The results of this research show that law enforcement officers who should have responsibility in their duties and authority are still found to be abusing their duties. In Indonesia, the law does not differentiate between anyone, therefore law enforcement officers who abuse their duties and authority can be subject to sanctions, from the general court or from the professional code of ethics.
