Abstract

and society. Law enforcement efforts against perpetrators of corruption involve various actions, including the confiscation of assets obtained from the proceeds of corruption. This asset confiscation has the main purpose of returning stolen assets to the state, ensuring that perpetrators of corruption do not benefit from their illegal actions, and furthermore, to realize justice in society. Fundamentally, asset forfeiture is an important step in the fight against corruption. However, its implementation often involves a number of legal challenges and debates. This research explores the process of asset forfeiture, the legal regulations that govern it, as well as the challenges and changes that have occurred in the Indonesian context. In the pursuit of justice, it is important to ensure that the asset confiscation process is transparent, fair and in accordance with the law. This means that the rights of individuals must be respected, and the legal process must prioritize the presumption of innocence. However, while the legal process is ongoing, there should not be protracted delays that allow perpetrators of corruption to avoid accountability. Based on this background, the problems studied in this research are: 1). What is the legality of confiscation of assets obtained from corruption crimes by law enforcement officials, 2). Legal research is a process to find legal rules, legal principles, and legal doctrines in order to answer the legal issues at hand, legal research is carried out to find solutions to legal issues that arise. Therefore, legal research is a research within the legal framework (Peter Mahmud Marzuki 2005) The results achieved are to provide prescriptions in solving problems In this study the authors used normative research. This step aims to stop the use of the proceeds of corruption by the perpetrators of corruption, as well as recovering assets suspected of originating from the proceeds of the crime. Asset confiscation is also influenced by the need for the effectiveness of law enforcement and the achievement of justice for the community.
