Abstract
Telesurgery is a new surgical system that utilizes wireless networks and robotic technology to connect surgeons and patients who are located far from each other. Telesurgery is a new concept that is very necessary in medical practice because of the many benefits and opportunities it creates. However, in the use of telesurgery, many legal problems arise, because there are no regulations governing medical services between doctors and patients via telesurgery. Thus, this can result in legal uncertainty and skepticism. The aim of this legal research is to determine the use of robotic telesurgery technology in medical practice from a health law perspective. This research was conducted using a juridical-normative method and was supported by a statutory approach and also a conceptual approach. The results and conclusions of this research are that the practice of administering telesurgery in Indonesia currently still refers to Law no. 17/2023 and Law no. 29/2004, which regulates conventional health services, because Indonesia still does not have legislation that specifically regulates telesurgery. When practicing telesurgery, malpractice occurs, the responsibility is borne by the doctor, doctor staff and nurses. Responsibility in the event of malpractice can be seen from a civil law perspective consisting of responsibility for breach of contract and responsibility for unlawful acts.
