Abstract

Restrictions on adherents of Communism in Indonesia have become a threat to the right to think and express opinions in Indonesia. Adherents of communist ideology in Indonesia have the right to freedom of thought according to their conscience. Freedom to express one's thoughts is a fundamental human right contained in Article 28 of the 1945 Constitution, therefore the state cannot prohibit freedom of thought, including the ideology of communism in Indonesia, on any basis, even under any circumstances. The state only has the authority to limit all citizens' actions with positive law, rather than limiting freedom of thought activities which should not be reduced under any circumstances. These restrictions are contained in TAP MPRS XXV/1966 as the legal basis for forming various regulations to limit the human rights of adherents of communist ideology.This research is normative legal research, which examines the restrictions on human rights of adherents of communist ideology in Indonesia, then the fulfillment of human rights that should be obtained by adherents of communist ideology in Indonesia. With 3 (three) approach methods, namely the Legal Approach, Conceptual Approach and Historical Approach. From the discussion above, it can be concluded that restrictions on human rights for adherents of communist ideology must be immediately lifted because they are not in accordance with human rights, and the fulfillment of human rights for adherents of communist ideology must be immediately fulfilled.
