Abstract
This research aims to examine the offence of same-sex rape against adults in Indonesia. This research uses normative legal research. The approach used in this research is to use a statutory approach and a conceptual approach. The results of this study show that the importance of criminalisation for perpetrators of same-sex rape against adults in Indonesia. The act of same-sex rape against adults has not been regulated in Indonesian legislation. When looking at Article 292 of the Criminal Code, the article is only for perpetrators of same-sex rape whose victims are immature or underage then in Article 414 of Law No. 1 of 2023 concerning the Criminal Code in the article says that a person can be subject to the article if the person commits acts of same-sex sexual abuse in public, by force or threat of force, and publishes on social media but the article does not clearly mention the age limit of the victim whether underage or adult. Meanwhile, the interpretation of the term obscene is a deviation in the sexual field that leads to sexual intercourse, but not like sexual intercourse. It can be interpreted that the application of the term obscene both regulated in Article 292 of the Criminal Code, Article 414 of Law No. 1 of 2023 on the Criminal Code, and Article 76E of Law No. 35 of 2014 on the Amendment to Law No. 23 of 2002 on Child Protection are actually not intended for cases of same-sex rape against adult victims, therefore it is important to criminalise the perpetrators of same-sex rape against adults in order to create security and peace for all Indonesian people.
