Abstract

Corruption is the nation's main problem which has an impact on other problems, namely injustice, social inequality, poverty, poor public services and other social problems. The crime of corruption is included in extraordinary crimes, namely extraordinary crimes. One type of criminal act of corruption is gratification. In current developments, gratification is not only limited to giving luxury goods or money and so on, but is now provided with sexy services to state administrators. Explanation of Article 12B Paragraph 1 of Law Number 20 of 2001 concerning the Eradication of Corruption Crimes does not yet explicitly regulate sanctions for parties to sexual gratification, so it is necessary to know whether sexual gratification is part of the phrase other facilities and how the regulation of sexual gratification compares in India and Indonesia . The method used in this research is normative juridical using a statutory-regulatory approach, context approach, case approach, and comparative approach. The aim of this research is to find out sexual gratification as part of the phrase other facilities in Article 12b Paragraph 1 of Law no. 20 of 2001 concerning the Eradication of Corruption Crimes and to find out the calculation of sexual gratification regulations in India and Indonesia. The results and conclusions of this research are that, guided by the explanation of Article 12 B of Law Number 20 of 2001 concerning the Eradication of Corruption Crimes, the phrase other facilities can be interpreted broadly, so that sexual services can be separated as part of the phrase other facilities because they fulfill the elements of Article 12 B paragraph 1 of Law Number 20 of 2001 concerning Eradication of Corruption Crimes. Based on a comparison of the regulation of sexual gratification in Indonesia and India, India has not expressly prohibited sexual gratification, in contrast to India which explicitly mentions the phrase sexy services in its corruption law in the extortion section, and India uses the term sextortion which is better known in India. as sexual gratification.
