Abstract
In developing its state system post-independence, especially during the New Order era, Indonesia has experienced various events leading to Human Rights violations. Until the year 2023, serious human rights violations have not been resolved, and the victims have not received their rights to recovery, also known as reparations. The unresolved serious human rights violations from the past indicate a low success in organizing the protection and enforcement of human rights in Indonesia. Despite Indonesia ratifying numerous international statutes, it has yet to be able to address existing human rights issues. The main obstacle in resolving past cases of serious human rights violations in Indonesia is the need for more political will from the state apparatus, resulting in ineffective regulations that cannot be implemented. This research adopts a Normative Juridical approach by conducting a literature review of books and legal regulations related to the core issue. The methods used include legislative analysis, conceptual approaches, and case studies. Therefore, this research aims to comprehensively discuss the rights the state must fulfill for victims of past serious human rights violations and the mechanisms capable of fulfilling these rights. Existing regulations do not fully address the victims' recovery rights, as the current mechanisms are not inherent to the victims and depend on the guilt of the perpetrators. The absence of compensation leads to many aspects of recovery rights not being granted, causing the state to fail to fulfill its obligations.
