Abstract

Children are the next generation of the nation that must be protected for their rights as children, children's contribution to the world of work is a problem in the business world that must receive attention. Child labor in the informal sector is a child who works in a business that does not have a permit from the authorized government that is not registered with government agencies. According to Law Number 13 of 2003 concerning Manpower, the State has an obligation to deal with child labor outside of working relationships, so it is necessary to know the forms of government countermeasures against children working in the informal sector. The method used in this research is normative juridical using conceptual approaches and statutory approaches. The purpose of this study is to determine the urgency of protection for child laborers working in the informal sector and to determine the forms of government obligations in protecting children working in the informal sector. The urgency of protection for informal sector child laborers includes protection of children's rights, children are vulnerable to threats, children's rights are vulnerable to being violated, vulnerable to discrimination, exploitation, and vulnerable to dropping out of school so they need to be specially protected. The form of government obligations towards child labor in the informal sector is internally carried out through employment contracts that can protect children from their rights as child laborers, the existence of employment contracts can provide protection for child laborers in the informal sector. External protection is based on Protection Legislation in Law No. 1 of 2000 Concerning the Ratification of Ilo Convention No. 182 Concerning The Prohibition And Immediate Action For Elimination Of The Worst Forms Of Child Labor that obliges the state to prohibit and eliminate the worst forms of child labor. Article 75 of Law Number 13 of 2003 Concerning Manpower that the government is obliged to make efforts to prevent infomal child labor. Law No. 17 of 2016 Concerning Child Protection where special protection to economically exploited children is carried out by socializing the provisions of laws and regulations relating to the protection of economically exploited children, monitoring, reporting, witnessing and involving employers, communities in the elimination of child exploitation.
