Abstract
Leave is a break given by the company to its workers to rest and carry out official permits for a period of time. Paternity leave is one of the leave arrangements given by companies to male workers to accompany their wives after giving birth. However, in implementing paternity leave, it still creates inequality between genders. This research aims to determine the urgency of regulating paternity leave in Indonesia and the comparative concept of paternity leave in Indonesia and Australia. The research method used is a normative juridical method with a statutory approach, a conceptual approach and a comparative approach. The results of this research show that there are differences in leave rights between Civil Servants (PNS) as regulated in the Republic of Indonesia State Civil Service Agency Regulation Number 24 of 2017 concerning Procedures for Granting Leave to Civil Servants and private employees as regulated in Law Number 13 of 2003 regarding Employment. Paternity leave is an arrangement that has positive value, however there is still injustice due to gender inequality contained in the regulations with a fairly large comparison of leave rights. The urgency of paternity leave arrangements was created to follow the child's growth and development as well as to prevent baby blues in mothers after giving birth. The difference between Indonesia and Australia lies in the length of leave rights and there is adoption leave in Australia, whereas in Indonesia there are no child adoption leave regulations yet.
