Abstract

Child care places in Indonesia are very much needed for working parents. The availability of child care places is a form of the state's obligation to fulfill the rights of its citizens. The absence of regulations regarding child care for working parents is one of the problems that can hinder both working parents and children's growth and development. This research aims to determine the regulation of state obligations in providing child care and also to determine the urgency of providing child care at the University of 17 August 1945 Surabaya. To answer these objectives, the method used in this research is empirical juridical with a statutory approach, a conceptual approach and a legal sociology approach. The results of this research are to provide knowledge regarding the provision of child care. Where the state is obliged to provide a place to support children's growth and development if both parents are required to carry out their obligations in working, while their children still need their rights to receive adequate care which is regulated in the 1945 Constitution Article 28B (2). As is the case in the education sector, especially at the University of 17 August 1945 Surabaya, it is important and urgent to provide childcare which aims to facilitate teaching staff, lecturers and students who have children aged 0-7 years. Child care is needed to ensure female workers work safely, calmly and optimally and can still provide the best care for children. This is in accordance with Presidential Instruction no. 9 of 2000 concerning Gender Mainstreaming in National Development and Regulation of the University Chancellor of 17 August 1945 Surabaya.
