Abstract
This research discusses sexual deviation in the context of the military environment. The TNI is a role model, therefore all actions carried out by TNI members must comply with the rules by avoiding disgraceful acts which can be subject to articles in the military criminal code and the criminal code. Sexual deviant behavior is the behavior of fulfilling sexual needs in an unnatural way where someone likes the same sex which is usually referred to as homosexual. The crime of sexual deviance in the military environment is an unlawful act that involves sexual behavior that is unethical, illegal, or detrimental to other people. The formulation of the problem discussed in this research includes "What are the provisions governing criminal acts of sexual offenses committed by military personnel?" and "What is the legal responsibility for criminal acts of sexual deviation committed by military personnel?". The research method used is normative legal research, with a focus on presenting legal rules, legal principles and legal doctrines that are relevant to answering the legal issues faced. This research aims to provide a comprehensive understanding regarding the legal handling of sexual deviation cases involving military personnel. The results of this research are that prohibitions related to sexual deviation are not regulated in statutory regulations. However, the prohibition regarding sexual deviations committed by military personnel is contained in the TNI Commander's Telegram Letter Number ST/398/2009 dated 22 July 2009 in conjunction with the TNI Commander's Telegram Letter Number ST/1648/2019 dated 22 October 2019 which Its contents regulate the prohibition of TNI soldiers from committing immoral acts with the same gender. Criminal liability in the form of disciplinary punishment contained in article 9 called the Military Law Law is then followed by administrative sanctions. TNI soldiers involved in cases of sexual deviation will be fired because these actions are contrary to legal, religious and cultural norms.these actions are contrary to legal, religious and cultural norms.
