Abstract

Legal Protection for Over the limit Land Rights Holders According to the Basic Agrarian Law is an important aspect in the agrarian legal system. The Basic Agrarian Law functions as the main basis for regulating land rights and providing legal protection to land rights holders. Holders of land rights have rights that are recognized and protected by law, including ownership rights, use rights, business use rights and rental rights. The implementation of the land registration system in Indonesia has not been able to create certainty of rights and orderly land administration, mainly due to the lack of adequate use of advanced technology by the National Land Agency. In theory, the government should prioritize the activities of survey, measurement and mapping deputies to create large-scale base maps and digital maps of land plots as well as other thematic maps with adequate databases in accordance with technological and legal developments in modern times. This will result in the production of cost-effective and efficient maps that can be utilized by other institutions to support accurate performance in providing and managing the required data. This approach involves reviewing the legal framework and principles governing the protection of land rights across borders according to the Basic Agrarian Law. The research method used is a normative research method using a statutory approach and a conceptual approach, which is carried out by analyzing primary and secondary legal materials that are related to the problem being studied.
