Abstract

Dijelaskan bahwa visi misi, dan program pasangan calon merupakan contoh bahan kampanye, namun baliho, spanduk, dan tanda lainnya dianggap sebagai alat peraga kampanye menurut undang-undang pemilu. Pendistribusian di luar jadwal, dalam hal ini, penyelenggara pemilu meyakini bahwa alat peraga kampanye yang memuat konten yang dilakukan atau disebarluaskan di luar jadwal kampanye dianggap sebagai pelanggaran kampanye dan akan dikenakan sanksi berdasarkan undang-undang terkait. Meski KPU tidak menjabarkan secara jelas apa saja yang ada dalam peraturan perundang-undangan, para peserta pemilu, baik perseorangan maupun partai politik, mendistribusikan alat peraga yang memuat visi, misi, nomor urut, dan foto diri karena mereka yakin ini bukan kampanye, apa yang boleh dan tidak boleh diterima dalam kegiatan kampanye. Konteks penelitian ini adalah ambiguitas peraturan tersebut. Oleh karena itu, tujuan utama dari penelitian ini adalah untuk mengetahui dan memperjelas apakah, dalam pemilu, pendistribusian alat peraga dan materi kampanye di luar jangka waktu yang dijadwalkan dapat dianggap sebagai pelanggaran kampanye. Pendekatan masalah penelitian ini memadukan pendekatan konseptual dengan pendekatan peraturan perundang-undangan. Temuan-temuan penelitian ini menunjukkan bahwa jelas-jelas melanggar undang-undang pemilu jika mendistribusikan materi dan alat kampanye di luar waktu yang dijadwalkan. Oleh karena itu, diperlukan aturan yang mengatur pembagian alat dan bahan kampanye di luar jadwal. Penerapan langkah-langkah ini dan peraturannya akan membantu meminimalkan pelanggaran kampanye di luar jadwal dan mengatasinya.
