Abstract
In the development of modern law, the Criminal Code has undergone changes, namely in Law Number. 1 Year 2023 on the Criminal Code (hereinafter referred to as the National Criminal Code). The National Criminal Code itself has embraced the concept of consolidation and the concept of integration which is in accordance with modern legal concepts. The punishment system in Indonesia is the culmination of the process of accountability in committing a criminal offense. In the system of punishment in Indonesia, initially retributive becomes alternative where there is no form of retaliation. alternative punishment becomes corrective, protects to prevent crime and protect society, and does not provide punishment. By looking at the journey of criminal law that has developed, the National Criminal Code has embraced alternative punishment. From the alternative punishment system, a restorative justice process was formed. Restorative justice or often called restorative justice is an alternative to the settlement of criminal cases, in which the mechanism focuses on punishment and switches to mediation. By looking at the National Criminal Code, the imposition of punishment in an article has been implicitly described and restorative justice in criminal law in Indonesia is not new, especially in the renewal of the criminal law which is in the National Criminal Code. So the purpose of writing this thesis is to examine, and analyze the application of restorative justice in criminal cases committed by the elderly, which is contained in the provisions of Article 70 of the National Criminal Code by looking at the age provisions of the elderly as stipulated in Law Number 13 of 1998. The method in this writing that is used is the legal research method (legal reseach) and uses normative legal research methods. In the approach used in this writing is by legislation, and other regulations. Legal materials are using primary legal materials and secondary legal materials. The results showed that there is a legal vacuum in restorative justice for the elderly in the National Criminal Code by referring to the age of the elderly in Law No. 13 of 1998 so that the elderly who are at the end of their age need specificity and look at the benefits of restorative justice for the elderly in a modern punishment system in criminal law now.
