Abstract
Based on Law 24 of 2009 concerning Medical Practice as amended by Law No. 17 of 2023 concerning Health, many medical actions taken by patients in Article 45 of the Medical Practice Act have been regulated regarding the approval of medical actions which are derived in the Minister of Health Regulation No. 290 of 2008 concerning Medical Action Approval. However, in its implementation, there are still informed consent problems in the field that have not been accommodated, namely regarding the confusion of health workers in dealing with patients with mental disabilities, and no one wants to give consent in informed consent. Based on this background, the problems studied in this study are: 1) how is the Legality of Providing Health Service Actions (Infomed Consent) to Patients with Mental Disabilities?, 2) How is Legal Protection of Patients with Mental Disabilities in Health Service practices? This research uses normative legal research methods. The method of approach that I use in legal research there are several statutory approaches (statute approach) and conceptual approaches (conceptual approach) and historical approaches. The results obtained by the author of this study are regarding Legal not persons with disabilities provide informed consent to the approval of health service actions.
