Abstract

Pelaksanaan Undang-undang Informasi dan Transaksi Elektronik Nomor 11 Tahun 2002 terkait tentang batasan usia minimum untuk mengakses media sosial belum ada kejelasan sehingga anak dapat menjadi korban dari pelecehan seksual yang terjadi dalam media sosial itu sendiri, dibuktikan dengan adanya pelecehan seksual anak yang terjadi pada madia sosial semakin meningkat setiap tahunnya. Belum lagi adanya fitur-fitur terbaru dari media sosial yang dinamakan Anonymous Chat yang berada dalam aplikasi Telegram dengan fitur canggih tersebut, sehingga seorang pelaku pelecehan seksual anak akan sangat mudah melancarkan aksinya tanpa perlu adanya tuntutan. Karna dalam Anonymous Chat itu sendiri tidak ada yang namanya identitas diri yang tertera ataupun sebuah peraturan yang mengatur tentang spesifikasi penggunaan atau batasan dalam Anonymous Chat. Dengan begitu penelitian ini menghasilkan sebuah rumusan masalah yaitu Bagaimana Dasar Hukum Terkait Pertanggungjawaban Pidana Terhadap Pelaku Pelecehan Seksual Anak pada Anonymous Chat Telegram. Jenis penelitian ini adalah penelitian normatif yang menggunakan pendekatan Perundang-undang (Statute Approach), Pendekatan Konseptual (Conceptual Approach). Adapun kesimpulan yang didapatkan bahwa secara yuridis pelecehan seksual melalui media sosial melanggar ketentuan Undang-Undang Informasi dan Transaksi Elektronik pada pasal 26 ayat (1) dan padal 45 yat (1), Undang-undang Pornografi pada pasal 4 ayat (1), dan Undang-undang KUHP dalam pasal 282 ayat ayat (1). Pelaku dapat dikenakan hukuman yang sesuai dengan peraturan perundang-undangan yang berlaku dan memiliki sifat hukum yang mengikat, namun belum adanya pengaturan tentang Anonymous Chat pada Undang-undang sendiri maka pelecehan seksual yang terjadi dalam Anonymous Chat Telegram hanya sebatas delik aduan.
