Abstract

The purpose of this study is to determine and explain how the position of MKDKI's decision as a recommendation in medical crimes and how the evidentiary power of MKDKI's decision in medical criminal cases. MKDKI has the main objectives of protecting patients, maintaining the quality of service to patients, and also maintaining the dignity of the doctor's profession, where it is actualized in the form of justice in the medical field. The type used in this research is normative legal research and this research uses several approaches, namely the statute approach, conceptual approach, and case approach. The results of this study indicate that the position of the MKDKI decision as a recommendation for medical criminal acts are: 1) the standard of action of doctors and dentists should not be solely seen from a general criminal view, 2) if the actions of doctors and dentists decided by MKDKI violate the discipline of the medical profession, the doctors and dentists can still be sued or questioned criminally, and 3) although the MKDKI decision is binding on doctors and dentists can still be filed criminally, this is because the medical profession is related to humans. Meanwhile, the evidentiary strengths of the MKDKI decision in medical criminal cases are: 1) issued by an authorized official or issued by an official institution, 2) MKDKI's decision is produced through a legal and legitimate process, 3) proof at the trial at MKDKI is the same as using criminal procedural law, and 4) the examination process and the trial process are carried out in depth and carried out by parties who are competent in their fields.
