Abstract
Sexual violence is a violation of human rights, a crime against human dignity, and a form of discrimination. Sexual violence is defined as a form of intercourse that is preceded by an act of violence or abuse or a form of forced obscenity. This case of sexual violence has various impacts both physically and psychologically for the life, growth and development of children. Which at this time cases of sexual violence against children are carried out by people who behave self-harm. The perpetrator of self-harm is a psychological disorder experienced by a person, this is clearly related to a person's psychology. Where people with psychological disorders are considered less competent to act legally. Therefore, the author examines the form of accountability for perpetratorsself-harm of sexual violence against minors? This research is a normative legal research by analyzing primary and secondary legal materials using statutory and conceptual approaches. The results of the study, where the perpetrator of the crime of sexual violence against children with self-harm behavior can still be held accountable because he does not experience mental illness and only has mental problems but he is still a competent person in the law because he is able to determine the consequences of his actions . The forms of criminal responsibility for perpetrators of self-harm in crimes of sexual violence against children are imprisonment, fines, and additional punishment.
