Abstract

Terminating investigations into criminal employment cases and payment of wages under the minimum wage provisions is a breakthrough in the criminal justice system, oriented towards victim recovery (restorative). Criminal law enforcement in Indonesia, with legalistic positivism oriented towards distributive justice (retaliation), does not provide benefits and justice to workers/laborers and employers as long as industrial relations continue. The concept of settling criminal cases in terms of paying wages below the minimum wage is realized through a peace process and an agreement with the Victim Offender Mediation (VOM) mechanism, which involves the responsibility of the perpetrators of crimes for victim recovery. This normative legal research focuses on the study of legal materials that are relevant to the problem. The statutory approach is to analyze positive legal provisions that form the basis for implementing the PPNS's authority as an investigator. It is hoped that a conceptual approach to studying the issue of the authority to stop investigations within the framework of the rule of law is expected to become an instrument that can describe the importance of ending investigations that create restorative justice. The philosophical approach is to gain a deeper understanding of the social implications and the effect of applying laws and regulations on society and find the legal concept of stopping the investigation of criminal employment cases by paying wages below the minimum wage based on the value of restorative justice. The essence of ending the investigation (SP3) is realized when the victim has forgiven the perpetrator through peace, and the loss is returned. The concept of settlement of criminal labor cases, through a peace process and agreement or Victim Offender Mediation (VOM), by involving the perpetrator's responsibility in recovering losses (restorative), which is carried out outside of litigation or during case investigations, is baseless for the State, to continue to process investigation.
