Abstract

freedom of expression in public is the right of Indonesian citizens in accordance with the constitution of the Unitary State of the Republic of Indonesia, namely the 1945 Constitution Article 28 E "everyone has the right to freedom of association, assembly and expression of opinion". One of the efforts to convey this opinion is by holding demonstrations, freedom of expression is regulated in Law Number 9 of 1998 concerning Freedom of Expressing opinions in public. In demonstration activities, there is often violence perpetrated by activity guards which results in injury. In this study there are two formulations of the problem, namely 1. How is legal protection for demonstrators from police violence reviewed by criminal law 2. How is law enforcement for perpetrators of violence against demonstrators reviewed by criminal law. The normative research method is the research method used. This study aims to analyze the legal protection for demonstrators from police violence in criminal law reviews, and in relation to law enforcement for perpetrators of violence against demonstrators in criminal law reviews. The results of this study are 1. Law No. 9 of 1998 concerning Independence Expressing opinions in public and Article 170 Kuhp is a guarantee of legal protection for demonstrators in the perspective of criminal law. 2. For the sake of achieving justice and legal certainty, police perpetrators of violence must be subject to legal proceedings in accordance with statutory regulations and be aggravated because their position is in accordance with Article 52 of the Criminal Code. This research is also expected to help to provide an understanding of the rights and obligations possessed by demonstrators. The functions and powers possessed by the police in handling demonstration activities.
