Abstract

The number of LGBT individuals in Indonesia continues to increase, making Indonesia the fifth country with the highest population of LGBT individuals. This can be attributed to extensive efforts from LGBT groups and organizations, both at the national and international levels. As a result, it has caused concerns among the society and demands for the government to restrict the freedom of LGBT groups. This research addresses two problem statements: How are the rights to freedom of movement for LGBT groups in Indonesia viewed from a human rights perspective based on Pancasila ideology? And what is the urgency of regulating LGBT groups in Indonesia? This research is conducted using a normative approach, focusing on legislation and conceptual analysis. The findings of this research reveal that the implementation of human rights in Indonesia is based on Pancasila as the state ideology. Pancasila recognizes, protects, and maintains a balance between individual rights and the rights of citizens. Certain provisions justify the restriction of rights, including those established by law based on moral values, religious values, and public order considerations. Therefore, the limitation of LGBT group's freedom aligns with the concept of human rights based on Pancasila. The LGBT movement to legalize their behavior is considered contradictory to the values of the divine that are enshrined in Pancasila, as well as conflicting with the moral values upheld by Indonesian society.Currently, there are no specific regulations governing LGBT individuals, despite the increasing openness and density of the group's development. Therefore, there is a need for regulations related to LGBT that maintain a balance between individual rights and the rights of society in a proportional manner, while prioritizing the preservation of values and norms held by the community, in addition to considering human rights and freedom. This will help create social stability and order.
