Abstract

Indonesia is a country that has abundant natural resources. Natural resources have an important value as development capital, namely as the basic capital to drive the country's economy. Various problems in mining management in Indonesia have caused the people and the State of the Republic of Indonesia to suffer losses since the enactment of the first Mining Law in 1967, and have had a real impact on the welfare of the Indonesian people in the short and long term. The real impact is that economic development is not evenly distributed and the poverty rate is still quite high in the regions, even ironically the highest poverty rate is in mining producing areas. The aim of the research is to find out and explain how the authorities of the Central Government and Regional Governments are related to the granting of Special Mining Business Permits (IUPK) according to the Mining Law and Regional (Autonomy) Regulations, as well as how the authority of the Regional Governments related to the utilization of natural resources is included in the granting of Business Permits Mining. The research method is normative legal research, with a statute approach and a conceptual approach. The 1945 Constitution of the Republic of Indonesia has regulated the control and utilization of natural resources for the welfare of the people. The latest Mining Law has revamped the mining management system in Indonesia with investors, from an 'agreement system' to a 'license system', as well as a change in management authority and mining licensing by the Central Government by delegating some mining affairs to Provincial Governments. The Provincial Government is the recipient of the delegation of mining management and permits from the State in accordance with the provisions of the Laws, as well as the recipient of the allocation of income from natural resources for regional development with The Regency/City Government, which aims to anticipate fiscal gaps in the regions.
