Abstract

Peran saksi dalam setiap dipersidangan perkara pidana sangat penting karena pada setiap keterangan saksi data mempengaruhi dan menentukan kecenderungan kepuasan hakim. Menurut Pasal 1 angka 26 Kitab Undang￾Undang Hukum Acara Pidana (selanjutnya disebut KUHAP), saksi tersebut merupakan orang yang dapat memberikan keterangnan untuk kepentingan penyidikan, penuntutan dan peradilan tentang suatu perkara pidana yang dia dengar sendiri, lihat sendiri hingga dia alami sendiri.. Dengan demikian dapat diajukan pernyataan-pernyataan dari rumusan masalah yaitu pertanggungjawaban pidana Justice Collaborator pada Putusan No. 798/Pid.B/2022/PN JKT.SEL dan perlindungan hukum terhadap Justice Collaborator dalam kasus tindak pidana pembunuhan berencana. Metode penelitian yang digunakan berupa penelitian normatif yang merupakan jenis penelitian hukum untuk menemukan suatu aturan hukum, prinsip-prinsip hukum dan juga doktrin-doktrin hukum guna menjawb sebuah isu hukum yang sedang dihadapi. Hasil dari penelitian ini menjelaskan mengenai pertanggungjawaban pidana bagi Justice Collaborator seperti penghapusan atau pengurangan masa hukuman, mendapatkan perlindungan dari tindakan balasan, kerahasiaan identitas, pertanggungjawaban dalam pengaturan program perlindungan dan dalam hal perlindungan hukum bagi justice collaborator dalam tindak pidana pembunuhnan berencana yang mendapatkan perlindungan hukum khusus seperti perlindungan fisik dan psikis dan penghargaan bagi justice collaborator dengan berbagai syarat agar bisa menjadi atau ditetapkan sebagai justice collaborator.
