Abstract

PERPPU is the authority of the President based on Article 22 paragraph (1) of the 1945 Constitution of the Republic of Indonesia which can be formed based on a condition of compelling urgency, PERPPU Number 2 of 2022 on Job Creation was originally intended to answer the Constitutional Court Decision Number 91/PUU�XVIII/2020. The purpose of this research is to find out how the procedure for forming a PERPPU according to statutory provisions and how PERPPU Number 2 of 2022 on Job Creation is in accordance with the Constitutional Court Decision Number 91/PUU-XVIII/2020. This research is normative legal research and uses several approaches, namely the statutory approach, conceptual approach and historical approach. The results of this research indicate that the procedure for forming a PERPPU is regulated in Article 58 paragraph (1) and paragraph (2) of Presidential Regulation Number 87 of 2014 concerning the Implementation Regulations of Law Number 12 of 2011 concerning the Formation of Legislation, and in the formation of PERPPU Number 2 of 2022 concerning Job Creation there is no compelling urgency and is not in accordance with what is meant in the Constitutional Court Decision Number 91/PUU-XVIII/2020.
