Abstract

Restorative justice in principle is an approach used to solve problems outside the court with mediation or deliberation in achieving a justice expected by the parties, namely, among others, the perpetrators of criminal acts and victims of criminal acts to find the best solution agreed upon by the parties, especially regarding restorative justice for narcotics abuse. The purpose of this study is to determine and explain the legal basis of the Prosecutor's authority in resolving criminal acts of narcotics abuse based on restorative justice, and to determine and explain the legal consequences of the Prosecutor's authority in resolving criminal acts of narcotics abuse based on restorative justice. The method used in this research is using normative law, and using statutory, conceptual, and case approaches. The results of this study are the authority of the prosecutor in cases of criminal acts of narcotics abuse using restorative justice based on the basis of Prosecutor Guidelines Number 18 of 2021 concerning Completion of Case Handling through Rehabilitation with a Restorative Justice Approach as an Implementation of the Dominus Litis Principle of the Prosecutor, and the Lamongan District Attorney's Office resolved the case of a criminal act of narcotics abuse committed by the perpetrator on behalf of M. Farid using restorative justice because the perpetrator had met the requirements to be given restorative justice.
