Abstract

Nowdays namely the modern era where everything is digital, it does not rule out the possibility of digital theft and the need for legal protection for victims of digital theft. This study aims to identify and explain legal protection for victims of digital theft in the perspective of electronic transaction information law and also aims to identify and explain legal remedies that can be taken by victims of digital theft. Digital tools are also known as cyber or online tools. The formulation of the research problem is how to provide legal protection for victims of digital theft and what legal remedies can be taken by victims of digital theft. This study discusses forms of legal protection in the context of electronic transaction information law using normative legal research methods, particularly approaches based on statutory regulations. legislative invitation and legal doctrine. Electronic transaction laws protect victims of digital theft. The result of legal protection for victims of digital theft crimes is to provide a sense of security over the right to personal data protection, the right to security and privacy in the use of information technology, the right to law enforcement against criminals in cyberspace, the right to recognition of electronic evidence as legal evidence before the court, the right to protection against misuse of personal data and also by carrying out a civil lawsuit or the perpetrator can be given administrative sanctions, namely with a maximum imprisonment of 12 years and/or a criminal sanction of a fine of up to 12 billion and the result of efforts The law that victims of digital theft can do is to report the incident of the crime to the authorities so that they can get their rights back and can also take preventive measures so that the crime does not occur.
