Abstract

Arrangements regarding the principle of elections for members of the House of Representatives in the constitution are regulated in Article 22E paragraph (3) of the 1945 Constitution of the Republic of Indonesia. This research aims to find out what Article 22E paragraph (3) of the 1945 Constitution of the Republic of Indonesia means and to find out whether the closed proportional system is in accordance with the 1945 Constitution of the Republic of Indonesia. The type of research used is normative legal research, and uses two approaches, namely the statutory approach and conceptual approach. The results of this research show that in the interpretation of originalism, the meaning of Article 22E paragraph (3) of the 1945 Constitution of the NRI is: 1) because political parties are a manifestation of the political will of the people, 2) political parties can offer political views that are different from one another, 3) the existence of political parties in the election aims to provide alternative choices for the people, 4) the participation of political parties in the election is intended to be able to determine the majority winner, and 5) to distinguish with the election of DPD members. As well as the application of the electoral system is an open legal policy and is the authority of the legislator, and if using the concept of popular sovereignty, it shows that the open proportional system is more in accordance with the electoral system desired by the 1945 Constitution of the Republic of Indonesia, this needs to be linked because the principle of popular sovereignty is always a unity in relation to elections, meaning that the application of a closed proportional system is not in accordance with the 1945 Constitution of the Republic of Indonesia because it will close the space for the people to determine their choices directly, because in this system the determination of who the DPR candidates will sit in parliament is absolutely the authority of political parties.
