Abstract
Transsexuals who have changed sex from male to female or female to male through genital reassignment surgery. This certainly has an impact on laws related to gender issues. One of these laws is the law related to inheritance rights. So that the formulation of the problem in this thesis research is whether changing sex (transsexual) affects the share of heirs in Islamic Law and how is the determination of inheritance for heirs who change sex (transsexual). The research method used in this thesis research is the normative legal research method, which is a process to explore, find and find legal principles, legal principles, or legal doctrines that will be used in providing answers when faced with the law. The approach used in this thesis research is the statutory approach and the conceptual approach. The results of this thesis research are first, the legal position of inheritance for a traneksual person who performs genital surgery intentionally without any urgent reasons from male to female or vice versa, from female to male, his inheritance status is judged based on his original gender or previously, for transeks men who change their gender to become female, in Islamic inheritance their legal status is still recognized as the male heir and vice versa, but if the sex change is due to health reasons such as multiple sex, then it is seen from the sex after surgery. Second, in the context of inheritance distribution for someone who has changed their sex or is transeksual, this does not change their inheritance status. Thus, the share of inheritance for transeksual peopleis still the same as the sex before the operation. This is based on the prohibition of Allah SWT contained in Q.S al-Hujarat verse 13 which prohibits humans from changing themselves. Apart from that, the MUI fatwa also states that changing the genitals from male to female or vice versa on purpose without any reason for benefitis unlawful. So that the inheritance status and inheritance of the transeksual who performs genital surgery is the same as the original sex as before the operation. It is important for the whole community to know about the importance of knowing the legal status of inheritance for someone who changes sex and it would be better if this was regulated in positive law in Indonesia.
