Abstract

This thesis is entitled “Juridical Review of Administrative Sanctions Decisions Against Practicing Doctors Without a Practice License (SIP)”. In writing it uses normative research methods, using a statutory approach, a conceptual approach. This research is a legal research aimed at finding legal principles, as well as various legal doctrines that can be used to answer the legal issues at hand. Quoting from Peter Mahmud Marzuki, normative legal research is a process to find a rule of law, legal principles, and legal doctrines to answer the legal issues at hand. The formulation of the problems in this study are: (1) What is the juridical review of administrative sanction decisions against practicing doctors without SIP? (2) What is the analysis of criminal sanctions for practicing doctors who commit medical negligence based on restorative justice? The conclusion is that, in the first formulation of the problem, namely contained in the decision of the Constitutional Court in case Number 4/PUU-V/2007 that in Article 75 Paragraph (1) and Article 76.79 letters a and e of Law No.36/2004 has created feelings insecurity and fear as a result of disproportionate between the offense committed and the criminal threat stipulated in the law. This is not in accordance with the intent of Article 28G Paragraph (1), 28H Paragraph (1) of the 1945 Constitution of the Republic of Indonesia. Thus it only maintains fines, threats of punishment in the form of imprisonment and confinement contained in these are not in accordance with the philosophy of criminal law and contradicts the Constitution of the Republic of Indonesia 1945, this article does not have binding law. The formulation of the problem is that it is a legal, clear and firm order to carry out mediation in accordance with the provisions in Article 29 of Law No.36/2009. Therefore, if a dispute occurs between a health worker or medical staff and a patient, the settlement of the dispute by means of mediation is in accordance with the basic philosophy of the four precepts of Pancasila, namely priority deliberation in decision making.
