Abstract

Sometimes the process of searching for information by journalists is not easy and some journalists have even been subjected to physical violence. Violence against journalists is a crime in the eyes of criminal law. In relation to physical violence against journalists, there are many motives, ranging from acts in the form of attacks on body parts or other parts that result in injury, even death. This study aims to determine the qualifications of physical and non-physical violence against journalists in carrying out their duties, as well as to determine the form of legal protection for journalists for physical and non-physical violence in carrying out professional duties. The type of research used is normative legal research and uses two approaches, namely the statutory approach and the conceptual approach. The results of this study show that physical violence against journalists is divided into three, namely: premeditated abuse, serious abuse, joint abuse, and non-physical violence against journalists includes: insults, use of derogatory words, harassment, acts of deprivation as well as deprivation. Meanwhile, the form of legal protection for journalists against physical and non-physical violence in carrying out professional duties includes preventive protection contained in Article 8 of Law No. 40 of 1999 and also criminal protection contained in Article 18 of Law No. 40 of 1999.
