Abstract

Persons with Disabilities are vulnerable people who often become victims of criminal acts such as immoral acts or rape. This discrimination does not only occur in the realm of life or social life but also in the realm of the criminal justice process where injustice often occurs so that the principle of Equality Before Law (equality before the law) is not optimally implemented. Laws that regulate people with intellectual disabilities already exist, but their implementation is not optimal. For this reason, this research wants to discuss the synchronization of legal protection and government efforts for people with mental disabilities who are in conflict with the law. Responding to the formulation of the problem in this research uses a normative juridical research method in which the method is to collect data from literature, through references and legal basis from existing legislation. The conclusion that can be drawn from this research is that the regulation regarding the protection provided to mentally disabled persons with disabilities is still not effective and specific, current regulations still state the rights of mentally disabled people in general, the implementation of existing laws is not optimal enough to provide adequate legal protection. aims to create justice.
