Abstract

There are various kinds of crimes that a person can commit, one of which is sexual violence. Sexual violence is an act of sexual harassment against someone without the consent of the party concerned, sexual violence can occur anywhere and anyone throughout the world, one of which is in the field of education. Sexual violence is a crime that often occurs in education and one of which can occur in tertiary institutions. This study aims to determine the differences in the authority of the task force for prevention and handling of higher education sexual violence and the authority of the police in dealing with cases of sexual violence. This research is research using normative legal research methods. While the approach method is a statutory approach, a case approach and a conceptual approach. This study aims to explain that the challenges faced in the regulations for the prevention and control of sexual violence in tertiary institutions are based on the differences in authority of the two parties, namely the Task Force for the Prevention and Handling of Sexual Violence (Satgas PPKS) and the Police. The results of this study indicate that there are differences in handling and also the authority of the PPKS Task Force and the Police in dealing with cases of sexual violence that occur in tertiary institutions, the differences are very clear and one can see one of them, namely the difference in the PPKS task force which deals with cases of sexual violence through law. Whereas the rector's decision can be challenged at the State Administrative Court because the rector can be equated with state administration officials in terms of its function, lawsuits against the rector's decision can be filed by parties who feel aggrieved and are individuals.
