Abstract
Settlement of criminal cases can be reached by using the litigation route or non�litigation path. In Indonesia, the settlement of minor criminal cases is carried out through litigation because the method of settlement through litigation is the most frequently used method. In practice, solving problems through litigation can lead to new problems, such as punishment patterns that are retaliatory in nature, create more confusion, do not pay attention to victims' rights, do not restore the impact of crime, do not reflect justice to society, are not in accordance with the principle of simple justice, . With the emergence of an innovative approach to the concept of restorative justice, it is hoped that in the future it will be able to create a justice system that reflects a sense of justice and benefits for society in accordance with the values contained in Pancasila. This paper is the result of normative research by finding a rule of law, principles, and legal doctrines to answer legal issues. So it can be concluded that with the concept of restorative justice, perpetrators receive legal protection, including solving problems using non-litigation channels, avoiding the negative stigma of society. Meanwhile, legal protection for victims is by restoring the situation to the way it was before, by returning the goods to the victim, paying for the losses incurred, repairing any damage caused by the crime that occurred. So that the concept of restorative justice is expected to be able to provide a win-win solution for requests.
