Abstract

Conflicts or disputes that occur between humans are quite broad in dimensions and scope. Conflicts and disputes can occur in the public (general) and private (individual) areas. Conflicts and disputes can occur in the public (general) and private (private) areas. Alternative methods of dispute resolution according UU No 30 tahun 1999 about Alternative dispute resolution is Arbitrase, Negosiasi, Mediasi, dan Konsiliasi. However, one form of dispute resolution in private/civil law is mediation. However, cases that can be resolved through the mediation process can be viewed from Pasal 4 Perma No.1 Tahun 2016 about mediation in court. namely all civil disputes submitted to the Court including cases of resistance (verzet) on verstek decisions and resistance of litigants (partij verzet) and third parties (derden verzet) against the implementation of decisions that have permanent legal force, must first seek a settlement through Mediation. The type of research used is Normative Juridical which focuses on and limits its activities to the literature by making the conceptual, legislative and comparative approaches as the basis for the research. Observing the meaning of Mediation, it can be said that it is ideal in order to realize the principle of a fast, simple and low-cost trial if it is successfully implemented. Next, there are principles that must be considered, one of which is the principle of good faith. Because with the principle of good faith, each party that enters into an agreement can guarantee the fulfillment of all rights and obligations arising from the existence of the agreement. In the event that an agreement is deemed to have violated the principle of good faith, the law gives authority to the judge to amend or even delete part or all of the agreement. The principle of good faith also provides instructions that in carrying out an agreement each party should treat everyone fairly. On the other hand, there are legal consequences for parties who do not have good intentions, including the Plaintiff who is declared not having good faith in the Mediation process, the lawsuit is declared unacceptable by the Judge. The plaintiff is also subject to the obligation to pay mediation costs
